Planning Legal Due Diligence (for property, corporate and finance transactions)
It is important when either purchasing or leasing a property, or buying a property company or refinancing on a property to carry out a full planning legal due diligence
This due diligence exercise ensures that you have planning permission for the use or development of the property and advises you on any ongoing planning conditions and obligations under Section 106 legal agreements which attach to the property
As part of this exercise we can also advise you on whether there is any planning enforcement action relating to the property and whether or not the property is subject to Community Infrastructure Levy
This exercise can be carried out in conjunction with your property solicitor carrying out their due diligence into other aspects of the property and preparing their title report and can either form part of the title report or constitute a separate planning legal report
