Planning Clarity Legal Limited (“Planning Clarity Legal”) is a private limited company registered in England & Wales (No. 10279674) trading as Planning Clarity Legal.  A list of our directors is available at our registered office which is 3 Mountfield Road, London W5 2NG. References here and elsewhere on this website to ”the firm”, “we”, “us” or “our” mean Planning Clarity Legal.

Planning Clarity Legal is a solicitors practice authorised and regulated by the Solicitors Regulation Authority (Authorisation No. 631887).  

In accordance with the Solicitors Regulation Authority Indemnity Insurance Rules, Planning Clarity Legal has in place professional indemnity insurance with a Qualifying Insurer which complies with the requirements of the SRA Indemnity Insurance Rules.

Complaints procedure

We want to give you the best possible service. However, if at any point you become unhappy or concerned about the service we have provided then you should inform us immediately, so that we can do our best to resolve the problem.

In the first instance it may be helpful to contact the person who is working on your case to discuss your concerns and we will do our best to resolve any issues. If you are unable to resolve any concerns and you would like to make a formal complaint, then you can do so by writing to our Managing Director, Chad Sutton (chad@planningclaritylegal.co.uk) and request that he initiate our firm’s complaints procedure which is set out under the first heading below. This will involve a proper investigation of the circumstances leading to the complaint within an appropriate timescale which will be notified to you. Making a complaint will not affect how we handle your case.

Our firm’s complaints procedure

Upon receipt from you of a written formal complaint our Managing Director, Chad Sutton, will carry out the following procedure:

  1.  Acknowledge in writing receipt of your complaint within 3 working days of receipt and also record the complaint in our firm’s Complaints Register;
  2. Establish exactly what your complaint is about;
  3. Write to you within 10 working days of receiving your complaint explaining how the investigation will be managed and the timescales for any initial or substantive response to you;
  4. Carry out a full investigation and review of the complaint and the associated case, including discussing the complaint with the relevant person handling your case; and
  5. Write to you to report on our findings and conclusions including any recommendations, including providing details of how you can complain to the Legal Ombudsman should you be unhappy with how we have dealt with your complaint. 

We will endeavour to complete any investigation under this procedure as soon as we can and in any event within 8 weeks of the procedure having been formally invoked.

What to do if we cannot resolve your complaint

If we are unable to resolve your complaint then you can have the complaint independently looked at by the Legal Ombudsman. The Legal Ombudsman investigates complaints about service issues with lawyers.

The Legal Ombudsman expects complaints to be made to them within one year of the date of the act or omission about which you are concerned or within one year of you realising there was a concern. You must also refer your concerns to the Legal Ombudsman within six months of our final response to you.

We use trusted IT suppliers to protect and preserve the data we process and control. They employ upto-date data storage and security techniques to protect your personal information from unauthorised access, improper use or disclosure, unauthorised modification or unlawful destruction or accidental loss. All our employees and any third parties we engage to process your personal information are obliged to respect the confidentiality of your personal information.

We hold personal data and other information for different periods reflecting both good data protection practice and our regulatory, statutory and contractual requirements.
